TERMS & CONDITIONS

  1. Boompledge is a Pawn Shop Management Software designed to assist customers in managing their business operations.
  2. Lifetime Software License refers only to software ownership and does not include lifetime support, maintenance, cloud hosting, server services, or future enhancements.
  3. Lifetime Software License customers shall pay a Maintenance Plan fee of ₹99 per month from the 2nd year onwards.
  4. Maintenance Plan includes Technical Support, Software Updates, Cloud Backup, Security Improvements, and Server & Infrastructure Maintenance.
  5. If the Maintenance Plan is inactive, the above services may be suspended or discontinued until the plan is renewed.
  6. The software may be accessed on Mobile, PC/Computer, and Laptop devices using the same account, subject to applicable usage policies.
  7. All payments made to Boompledge are non-refundable and non-transferable.
  8. Boompledge reserves the right to revise pricing, maintenance charges, subscription plans, features, and service policies with prior notice.
  9. The Customer is solely responsible for all data entered into the software, including loan records, customer details, transaction records, and business information.
  10. Boompledge shall not be responsible for any loss, damage, claim, penalty, or legal dispute arising from incorrect data entry, misuse of the software, unauthorized access, or customer negligence.
  11. Customers shall not copy, reproduce, modify, distribute, resell, sublicense, reverse engineer, or otherwise exploit the software without prior written permission from Boompoo Global Mart Pvt Ltd.
  12. Boompledge reserves the right to suspend or terminate services in cases of non-payment, fraudulent activities, illegal use, abuse of services, or violation of this Agreement.

PRIVACY POLICY

  1. Customer data collected through Boompledge shall be used solely for providing software services, support, security, and operational purposes.
  2. Boompledge will take reasonable measures to protect customer data; however, no online platform can guarantee absolute security.
  3. Customer information will not be sold to third parties. Information may be shared only when required by law, court order, government authority, or regulatory requirements.

DATA PROCESSING TERMS

  1. The Customer retains ownership of all business data entered into the software.
  2. Boompledge acts only as a software service provider and data processor for the information entered by the Customer.
  3. Customers are responsible for maintaining the accuracy, legality, and completeness of their data.
  4. Upon service termination, Boompledge may retain or delete customer data in accordance with its internal data retention policies and applicable laws.

LIMITATION OF LIABILITY

  1. Boompledge shall not be liable for any indirect, incidental, special, consequential, or financial losses arising from the use or inability to use the software.
  2. Boompledge's total liability, if any, shall not exceed the amount paid by the Customer for the software subscription or license during the preceding 12 months.

INTELLECTUAL PROPERTY

  1. Boompledge software, source code, design, branding, trademarks, logos, documents, and related materials are the exclusive intellectual property of Boompoo Global Mart Pvt Ltd.
  2. No ownership rights, copyrights, trademarks, patents, or intellectual property rights are transferred to the Customer through this Agreement.

ARBITRATION & JURISDICTION

  1. Any dispute arising out of or relating to this Agreement shall first be resolved through mutual discussion and negotiation.
  2. If the dispute cannot be resolved amicably, it shall be referred to arbitration in accordance with applicable Indian laws.
  3. The courts having jurisdiction over Chennai, Tamil Nadu, India shall have exclusive jurisdiction over matters arising under this Agreement.
  4. 27. Force Majeure

    Boompledge shall not be liable for delays or service interruptions caused by events beyond its reasonable control, including natural disasters, internet outages, government actions, cyber-attacks, or other unforeseen circumstances.

  5. 28. Electronic Acceptance

    Acceptance of this Agreement through electronic signature, checkbox confirmation, OTP verification, digital consent shall be deemed legally valid and enforceable.

By proceeding with the purchase and use of Boompledge Software, I hereby confirm that I have read, understood, and agree to the following:

I understand that my continued use of Boompledge Software constitutes acceptance of all the above policies, including any future updates published by Boompledge.

The Customer confirms that they have read and accepted the Terms & Conditions, Privacy Policy, Refund Policy, AMC Policy, and Software License Agreement available on the official Boompledge website. These policies form an integral part of this Agreement and are binding upon the Customer.
